1. Provider and scope

1.1 This website, iapa.org (the "Website"), is operated by IAPA International Au Pair Association e.V. , Oetztalerstr. 1, 81373 Munich, Germany. IAPA is registered in the register of associations (Vereinsregister) of the Amtsgericht München under VR 209926 and is represented by its board pursuant to § 26 BGB: Jean Quinn, Charlotte Cappa-Domange, Kati Mäder and Renán Herrera. 1.2 IAPA is a non-profit association (Idealverein - Verband) that represents organisations in the au pair and cultural exchange sector worldwide.

1.3 These Terms of Use apply to the use of the Website. For IAPA members, the rights and obligations arising from membership are governed by the IAPA statutes (Satzung) and the resolutions of IAPA's bodies. In case of conflict, the statutes take precedence over these Terms of Use.

2. Use of the website

2.1 The publicly accessible parts of the Website may be used free of charge and without registration.

2.2 Users must not use the Website in a way that impairs its operation, circumvents access restrictions or infringes the rights of IAPA or third parties.

2.3 IAPA may change, restrict or discontinue the Website or parts of it at any time. There is no entitlement to the Website being permanently available

3. Copyright and rights of use

3.1 The texts, images, graphics, design and software on this Website are protected by copyright and related rights. IAPA holds the rights of use (Nutzungsrechte) or uses the content with the permission of the respective rights holders. The member and search databases on this Website are protected as databases under §§ 87a ff. UrhG; IAPA is their maker.

3.2 You may view the content and save or print individual pages for your personal, non-commercial use. Any further reproduction, distribution, public communication or modification requires IAPA's prior written consent, unless permitted by law (in particular the right to quote under § 51 UrhG).

3.3 Press releases and notices expressly intended for the public may be copied and distributed freely, provided IAPA is named as the source.

3.4 Names, logos and trade marks shown on the Website, including the IAPA name and logo, may not be used without IAPA's prior written consent. Active IAPA members have permission to use the IAPA logos to show their membership.

4. Content and external links

4.1 IAPA prepares the content of the Website with care. However, IAPA cannot guarantee that the information is complete, accurate and up to date at all times. The content is for general information only and does not constitute legal or other professional advice.

4.2 Information provided by IAPA members or other third parties, such as member profiles or offers, is the responsibility of the respective provider.

4.3 The Website contains links to external websites over whose content IAPA has no influence. The respective operator is responsible for the content of linked pages. No unlawful content was apparent when the links were set. IAPA will remove such links promptly if it becomes aware of any infringement.

5. Liability

51 IAPA is liable without limitation for damage caused intentionally or through gross negligence, for damage resulting from injury to life, body or health, and in cases of mandatory statutory liability.

5.2 In cases of slight negligence, IAPA is liable only for the breach of an essential obligation (Kardinalpflicht). An essential obligation is one whose fulfilment makes the proper use of the Website possible in the first place and on whose compliance users may regularly rely. In that case, liability is limited to the foreseeable damage typical for this kind of use.

5.3 Any further liability for slight negligence is excluded.

5.4 The members of IAPA’s board work on a voluntary and unpaid basis. Their personal liability towards users is limited to intent and gross negligence. This limitation does not apply to damage resulting from injury to life, body or health. In all other respects, the limitations in 5.1 to 5.3 also apply in favour of IAPA’s board members, employees and other agents.

5.5 IAPA protects the Website and the data processed through it with appropriate technical and organisational measures. Users are responsible for protecting their own devices, for example with up-to-date security software.

6. Data protection

Information on how IAPA processes personal data when you use the Website is provided in our Privacy Policy (Datenschutzerklärung).

7. Changes to these terms

IAPA may amend these Terms of Use with effect for the future. The current version is always available on this page and shows the date of its last update.

8. Governing law and jurisdiction

8.1 These Terms of Use are governed by the law of the Federal Republic of Germany. If you use the Website as a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you have your habitual residence.

8.2 If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the use of the Website is Munich, Germany.

8.3 Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions remains unaffected. The statutory provisions apply in place of the invalid provision.
